Fixation post VI CPC - Case by NDNGSA at CAT Jabalpur
Due to Non-availability of FULL BENCH at Jabalpur CAT, the case of fixation (CM with 6500 & AF with 7450 as on
01/01/2006) by NDNGSA was scheduled for next hearing on 07/02/2014.
The hearing was attended by Mr. D K Choudhary,
President (CE)/NDNGSA, Mr. V K Shrivastava, Jt.Secretary of NDGBGOA (CE).

Prime Minister of India Approved Constitution of Seventh Central Pay Commission
NEW DELHI: Ahead of elections, the government on Wednesday announced constitution of the Seventh Pay Commission, which will go into the salaries, allowances and pensions of about 80 lakh of its employees and pensioners.
"Prime Minister Manmohan Singh approved the constitution of the 7th Pay Commission. Its recommendations are likely to be implemented with effect from January 1, 2016", finance minister P Chidambaram said in a statement.
The setting up of the Commission, whose recommendations will benefit about 50 lakh central government employees, including those in defence and railways, and about 30 lakh pensioners, comes ahead of the assembly elections in 5 states in November and the general elections next year.
The government constitutes Pay Commission almost every ten years to revise the pay scales of its employees and often these are adopted by states after some modification.
As the Commission takes about two years to prepare its recommendations, the award of the seventh pay panel is likely to be implemented from January 1, 2016, Chidambaram said.
The Sixth Pay Commission was implemented from January 1, 2006, fifth from January 1, 1996 and fourth from January 1, 1986.
The names of the chairperson and members of the 7th Pay Commission and its terms of reference will be finalized shortly after consultation with major stakeholders, Chidambaram said.

Fixation post VI CPC - Case by NDNGSA at CAT Jabalpur
The case of fixation (CM with 6500 & AF with 7450 as on 01/01/2006) by NDNGSA was scheduled for hearing on 30/07/2013. Government counsel demanded another 4 months time but court disallowed the request and scheduled the case for final hearing on 08/10/2013. Court also ruled that no further time will be allowed.
The hearing was attended by Mr. D K Choudhary, President (CE)/NDNGSA, Mr. V K Shrivastava and Mr. B M Barik, both office bearers of NDGBGOA (CE) and veteran leaders of NDNGS.

Junior Works Manager
It is a well established fact that NDNGS and NDGBGO both are striving hard to establish whether JWM is a Manager or a Supervisor. There is no doubt that if we say 'Mr. X', it itself means 'X' is a man but OFB has some doubt about this. Hence, when OFB has published advertisement for recruitment of JWM sometimes they have stated that duties will be of Managerial nature and sometime of supervisory nature. Let it be, Manager will remain Manager, doesn't matter whatever bullshitting is done by anybody.
People from NDNGS and NDGBGO are always criticized for using RTI for getting their rights instead of doing buttering to superiors. During response to an RTI application filed by one of our activist, UPSC has given the following documents which reveals that:
1. "JWM is a senior Group 'B' gazetted officer having duties of managerial nature".
2. For these duties he is to report to a divisional officer who is a Group 'A' officer.
and for concluding all the lies that OFB has told to MoD, DOPT and UPSC, following documents can be perused:

Sad demise of Hon'ble Shri M.S.Hariji, Patron
It is very saddening to state that Hon’ble Shri M.S.Hari ji,
Patron of NDNGSA and NDGBGOA, is no more with us but we are sure that he will
always be in our heart. He was a person who does not need any introduction. His
work / efforts towards the betterment of Ordnance employees, general public and
Defence production of India are unforgettable.
Let us pray to God almighty that ‘May his soul rest in peace
and he may get place in almighty’s heart’.

SENIORITY LIST OF CHARGEMAN / T & NT AS ON 01.01.2013
|
The
Central Seniority List published as on 2008 i.e. after merger of CM II and I,
have many discrepancies in arriving one’s seniority on All India basis. The
Central Seniority List should have clear criterion in arriving combined
seniority with details of ROTA / QUOTA followed in each factory, marks /
merit list, date of publishing result and date of holding post. Also many
individuals’ Names were missing in the published Central Seniority List.

OFB
has intimated that a Special Task Force team including dealing staff from
factories is being made for settling discrepancies and fast processing. This
will be completed with a time period of 2 months.
|

REVISING OF
INTERGRADE RATIO FOR CHARGEMAN / NT FROM 70:30 TO 60:40
|
The
inter-grade ratio of 60:40 is maintained for Chargeman (T) and JWM (T).
Whereas, for Chargeman (NT) and JWM (NT) is 70:30. Because of the disparity
in the ratios of Chargeman and JWMs, technical Chargeman are getting a
quicker promotion when compared to NT Chargeman.

OFB
replied that the ratio is fixed studying the functional requirements of
Ordnance Factories and decided thereon and hence it shall not be considered.
|

INCREASING OF
RATIO OF JWM (NT/OTS) BASED ON STRENGTH OF OFFICE SUPERINDENTANT
|
The
strength of JWM (NT/OTS) at present has been calculated on the basis of
strength of Chargeman (NT/OTS) alone. The strength of Office Superintendent
is not being considered while calculating the strength of JWM (NT/OTS). This
affects the inter-grade ratio of 70:30 to become 86:14 presently resulting
delayed promotions.

OFB
agreed with the proposal of NDNGSA and intimated that they will be forwarding
a proposal to MoD for considering strength of OS for revision of strength of
JWM(NT/OTS). This will create 540 vacancies in JWM(NT/OTS)
|

|
TRANSFER POLICY
|
Mutual
Transfer cases and Forwarding of applications of Chargeman seeking transfer
to new project factories are getting denied by the factory. The case
regarding non-forwarding of application by factories for OF Korwa is taken up
as a special case.
|
Transfer
policy is being formulated by OFB and will be followed uniformly. Chairman
directed to issue instructions to all factories to forward all the
applications with comments of factory management.
|

PLB TO DR
CHARGEMAN
|
Productivity
Linked Bonus is not being issued to DR Chargeman during Probationary period.
OFB should take a proper initiation and necessary amendment in the existing
OFB instruction No. 07/09/07-A/HRD dated 09.07.2007.
|
OFB
agreed the justification and is issuing a letter / clarification to PCFA for
grant of PLB to DR Chargeman.
|

NPS ANNUAL
STATEMENT TO NPS CHARGEMAN
|
NDNGSA
explained the discrepancies in the NPS deductions and no proper action
towards unsettled issues on deductions. It also recommended to provide annual
statement of NPS to every NPS Subscriber on par with GPF statement issued to
GPF Subscribers
|
OFB
will take up the matter with PCFA to issue annual statement on lines of GPF
statement.
|

|
OUTSIDE
EMPLOYMENT
|
With
the exception for UPSC, these days refusal of NOCs and not forwarding
applications for outside employment is found common. OFB/Factory Management
shall have to follow a persistent, clear and rational system.
|
Chairman
opined that GMs being appointing authority of CM are competent to take
decision in ‘Public Interest’. However OFB will issue directives in this
regard to follow a uniform policy.
|

|
PROVIDING OT
ALLOWANCE TO CM DURING DEPUTATION
|
During
deputation to Outstation for Escort duty, Running Trial Duty, Field Firing
and Exercise trials etc, CMs are required to work in uneven timings with no
Overtime Allowance. This brings disparity of Salary when at Local station.
Hence, Overtime allowance should be given to CMs during deputation to
Outstation
|
OFB
agreed to take up the issue to MoD regarding OT allowance during deputation
|

|
ENHANCING
EXEMPTION OF TRANSPORT ALLOWANCE FROM THE PURVIEW OF INCOME TAX
|
NDNGSA
asked that the Income Tax exemption for Transport Allowance should be enhanced
from Rs.800 to Rs.3200 per month plus DA thereon. At present Rs.800 is fixed
as per V CPC which was the maximum and hence it is required to enhance to
Rs.3200 which is the maximum as per VI CPC. For this, NDNGSA quoted reference
of Railway Board Recommendation to Ministry of Finance (Department of
Revenue) CBDT. Relevant papers of Railway and CBDT were handed over to
Director / IR
|
OFB
will make necessary correspondence with concerned departments to formulate
the grievance
|

|
RISK ALLOWANCE
|
Risk
Allowance should be given to all Chargeman working in Hazardous areas like
Chemical Plants, X-Ray areas, Electroplating and Heat treatment areas which
affects the health adversely over a long period of working, as per DOPT
order. NDNGSA brought to Board that at present NGOs working in Nitro Glycerin
areas are only getting Risk Allowance and remaining hazardous areas are not
considered.

Chairman
appraised for bringing up the matter to OFB. OFB(A/A section) will action
positively in consultation with Controller of Safety.
|

|
NIGHT DUTY
ALLOWANCE
|
Night
Duty Allowances are paid in the rates fixed during V CPC and are not yet
revised after VI CPC recommendations.
|
OFB
assured to take necessary action in revising the NDA rates as per VI CPC
|

|
TREATMENT OF CM
SELECTED UNDER LDCE SCHEME
|
NDNGSA
demands LDCE CM Should be treated as DR CM only to protect one MACP ignoring
rendered past service due to the acquired experience & qualification.
|
The
matter should be expedited with the consultation with DOPT.
|

|
RENAMING OF CHARGEMAN
|
Immediate
settling of re-naming issue to Chargeman should be opted and action of OFB in
this case shall be expedited. NDNGSA referred its proposal vide letter no.
NDNGSA(CE)/General/2012/71 dated 15.11.2012 in reply to OFB letter no
100/MISC/Renaming/A/NG dtd. 08.11.2012
|
OFB
asked to re-submit a common proposal which shall be admitted by both of the
NGOs’ Associations. In this regard, NDNGSA (CE) discussed with General
Secretary, AIANGO on the same day (27.04.2013) for a fruitful decision on the
proposal. However, it has been decided to come back with a common proposal
after discussion at CE and branches.

commented on not following DPC procedures and haphazard list of promotions of
Chargeman to JWM.

intimated that review DPC 2012-13 is being done for left out CMs. DPC for
2013-14 will take place after review DPC and preparation of Central Seniority
Lists.
